A Medical Marijuana Card Won't Protect You From a DUI
In this short video, attorney James J. Pasquali explains one of the most common mistakes he sees. Many Oklahomans believe a medical marijuana license makes it legal to drive after using. It doesn't. Under Oklahoma law, any detectable amount of an intoxicating substance in your blood can support a DUI charge, and THC can show up in a blood test weeks after use.
- A first marijuana DUI is a misdemeanor carrying 10 days to 1 year in jail.
- A second DUI within 10 years can be charged as a felony.
- Telling an officer “I have a license” won't help. Don't answer questions without a lawyer.
